GENERAL TERMS AND CONDITIONS

1. SCOPE OF APPLICATION

These Terms and Conditions (T&C) apply to services provided by INSYNC CLUB for yoga classes, workshops, courses, private classes, and online programs. By purchasing a ticket or registering for any of the above services, the customer accepts these terms and conditions. The contractual partner is: Andrea Schauer MSc.

2. RIGHT OF USE

A) With the purchase of a valid ticket or registration for a workshop, course, or online program, the customer is entitled to access the relevant service at the specified times. The customer may be required to identify themselves upon request. Otherwise, access may be refused.

B) All services of INSYNC CLUB are in principle open to customers. However, there is no legal claim to the use of any specific service. For workshops, courses, and online programs, participant numbers are limited. Where specific requirements must be met for participation, these are the responsibility of the customer.

C) Participation in in-person classes and sessions is only guaranteed upon punctual arrival. For organisational reasons and out of consideration for other participants, admission cannot be guaranteed after the start of a session.

D) Customers must behave respectfully at all times, treat equipment and premises with care, and follow instructions from INSYNC CLUB staff. Mobile phones must be silenced during sessions. In cases of gross misconduct — including assault, harassment, insult, sexual harassment, or theft — INSYNC CLUB reserves the right to deny access immediately and without refund, including forfeiture of any unused passes.

E) In order to maintain the wellbeing of all participants, INSYNC CLUB reserves the right to refuse further service provision without giving reasons. In such cases, unused tickets will be refunded on a pro-rata basis.

3. CONTRACT TYPES AND CONDITIONS

3.1 Tickets

A) Non-use of INSYNC CLUB services for reasons within the customer's own sphere does not entitle the customer to a reduction or refund.

B) Tickets cannot be extended or paid out in cash. The right of use is transferable only for courses, workshops, private classes, and online programs upon written request at least 7 days before the start date. Regular drop-in yoga class tickets are non-transferable.

3.2 Prices and Payment

All prices are listed on the INSYNC CLUB website and are final prices inclusive of applicable VAT in accordance with Austrian law. Payment is accepted via credit card, PayPal, or SEPA bank transfer. Customers in arrears will be excluded from all future services until the outstanding amount has been settled.

3.3 Limited Participation & Schedule Changes

Venues used by INSYNC CLUB have limited capacity. Participation in a specific session cannot be guaranteed in cases of high demand; priority is given in order of registration. Cancellations at short notice due to special circumstances do not entitle the customer to a discount or refund. For open sessions, the customer may switch to another available session. For private sessions, a new date must be agreed upon. For workshops and courses, the right to participate in another workshop or course is forfeited. INSYNC CLUB reserves the right to change times and dates of open yoga sessions at any time.

3.4 Retreats

Multi-day retreats organised under the INSYNC CLUB brand are operated in cooperation with BE Travel Agency, which handles the booking, payment processing, accommodation, and on-site logistics of the retreat. By booking a retreat, the customer enters into a separate contractual relationship with BE Travel Agency for these travel-related services, in addition to their agreement with INSYNC CLUB for the yoga and program content. Cancellation policies, payment terms, and travel-related liability for accommodation, transport, and logistics are governed by BE Travel Agency's own terms and conditions, which will be provided to the customer separately. INSYNC CLUB remains solely responsible for the design and delivery of the yoga, movement, and program content of the retreat.

4. ONLINE PROGRAMS

4.1 Delivery
Online sessions are delivered via Zoom or an equivalent video conferencing platform. A stable internet connection and a compatible device are the sole responsibility of the participant. Technical difficulties on the participant's end do not entitle them to a refund or make-up session.

4.2 Access & Login
Access links are strictly personal and may not be shared with third parties. Sharing access constitutes a material breach of contract and may result in immediate removal from the program without refund.

4.3 Recordings
Sessions may be recorded by INSYNC CLUB and made available to enrolled participants for a limited period. Participants may not record, screenshot, or reproduce any session content without prior written consent from INSYNC CLUB.

4.4 Intellectual Property
All program content, materials, frameworks, methodologies, and PDFs are the intellectual property of Andrea Schauer / INSYNC CLUB. They may not be reproduced, redistributed, taught, or used commercially without prior written permission.

4.5 Cancellation by INSYNC CLUB
If INSYNC CLUB is unable to deliver a session due to illness or unforeseen circumstances, a replacement date will be offered. If the program cannot be completed in full for reasons within INSYNC CLUB's control, participants will receive a pro-rata refund for undelivered sessions.

5. LIABILITY OF INSYNC CLUB

The customer is informed that in some premises there are no lockable lockers or similar storage. Items brought to sessions are left unattended at the customer's own risk. Participation in all INSYNC CLUB services is at the customer's own risk. INSYNC CLUB is not liable for accidents or resulting physical damages. INSYNC CLUB is also not liable for the consequences of improperly performed exercises. Liability for financial and property damages is limited to intent and gross negligence, except where damages result from a breach of core contractual obligations.

With regard to retreats, liability for travel arrangements, accommodation, and on-site logistics organised through BE Travel Agency lies exclusively with BE Travel Agency and not with INSYNC CLUB.

6. HEALTH STATUS OF THE CUSTOMER

By purchasing a ticket or registering for any service, the customer confirms that they are in suitable physical and mental health to participate in the relevant activities. Participation under the influence of drugs, alcohol, or impairing medication is not permitted. The services offered by INSYNC CLUB are not to be understood as therapy and do not replace medical or psychological care. Customers confirm they are not suffering from any contagious condition at the time of participation. Chronic conditions or physical limitations that may affect practice should be disclosed to the instructor before each session. In the case of pregnancy, a medical release must be obtained prior to participation.

7. DATA PROTECTION

Personal data is collected and processed solely for the purpose of fulfilling the contract and for INSYNC CLUB's own communications. Data is not passed on to third parties. All data is handled in accordance with applicable data protection regulations (GDPR / Austrian DSG). Customer data is stored for a maximum of 10 years following the last interaction. Customers may request deletion of their data at any time by contacting INSYNC CLUB in writing.

8. MISCELLANEOUS

There are no additional agreements beyond these T&C. Changes must be made in writing; transmission by e-mail satisfies the written form requirement. Should individual clauses be found invalid, the remaining provisions continue in full force. The invalid clause shall be replaced by one that most closely reflects its original purpose. Austrian law applies. Place of jurisdiction is Vienna, Austria.
